Court declares Maltese trademark registration number 45392 “Zenya ACCESSORY WORLD” invalid on the grounds that the trademark was registered in bad faith [Art. 4(6) Trademarks Act 2000] and was of such a nature as to deceive the public or likely to deceive the public as to the nature, quality or geographical origin of the goods or service or in any other manner [Art. 4 (3)(b) Trademarks Act 2000]. Furthermore, the Court declared the above trademark registration invalid on the ground that the plaintiff company is the proprietor of an earlier right which is entitled to protection under Article 6(4) (a) and (b) of the same Trademarks Act 2000. This brought to a successful end litigation proceedings filed by CONSITEX S.A., owner of the ERMENEGILDO ZEGNA trademark portfolio.
